Our Returns & Warranty Policy constitutes an inherent part of our Terms of Sale and Service. Any terms used but undefined in this section shall have the meaning attached to them in the Terms of Sale and Service.
Kontakt.io Beacon, Double Battery Beacon, Tough Beacon, Gateway, USB-Beacon, Beacon Pro (“Beacons”) come with a 24 month warranty on the hardware; with exception of Card Beacon (“Beacons”) with 12 month warranty on the hardware – excluding batteries – commencing on the date of shipping (“Warranty Period”). Should our Beacons’ hardware fail at any time during the Warranty Period due to a production fault, we will replace them free of charge, including the shipping of replacement Beacons (“Warranty”). Please mind that the Warranty is not binding if the approximate cost of shipping exceeds the price of the Beacons you want to service, and we may refuse to replace them in such case.
The Warranty is void in the following cases:
- Beacons are used or stored improperly, i.e. what could reasonably be expected of an electrical device,
- Water or humidity damage,
- Intentional, accidental, or negligent damage,
- Physical damage or misuse, i.e. twisting, bending, wrenching, cutting
- Damage caused by force majeure (such as bad weather) or electrical disturbance (such as a power surge),
- Firmware modifications,
- Casing modifications,
- Component tampering, i.e. displacing, or modifying connectors or other fixed components
- Exposure to hazardous radiation or caustic chemicals.
We have the right to determine, in good faith and at our sole discretion, if the production fault caused the malfunction or it occurred due to one of the aforementioned reasons.
Exercise of the Warranty
If you wish to exercise the Warranty, you must first notify us by submitting us an RMA form available at http://kntk.io/rma and in good faith cooperate with our team in finding an efficient solution to the problem and, if we do not solve it, agree on the specific terms of replacement and delivery of defective beacons.
You will be responsible for all incurred shipping costs and potential damages if you send back the defective Beacons without prior consultation, as discussed in the preceding paragraph, or ignore our instructions (especially regarding the content of the bill of lading or proper packaging).
We take our clients very seriously and expect the same in return. Therefore, we do not envision the return right of properly functioning Beacons. Our Terms of Service describe your rights in the event Beacons are delivered to you in an unsatisfactory condition.
Consumer Laws of Your Country
For consumers, who are covered by consumer protection laws or regulations in their country of purchase or, if different, their country of residence, the benefits conferred by our Warranty are in addition to all rights and remedies conveyed by such consumer protection laws and regulations, including but not limited to these additional rights. Such consumers may also have the right to return beacons within certain period after the purchase. BEACONS PROVIDED TO YOU IN CONNECTION WITH THE AGREEMENT ARE PROVIDED TO YOU “AS IS”. APART FROM THE WARRANTY DESCRIBED ABOVE, WE DO NOT MAKE, AND HEREBY EXPRESSLY DISCLAIM, ANY WARRANTY OR REPRESENTATION WITH RESPECT TO BEACONS, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, PERFORMANCE, ACCURACY, RELIABILITY, AND NONINFRINGEMENT. KONTAKT.IO DOES NOT WARRANT THAT THE OPERATION OF THE BEACONS WILL BE UNINTERRUPTED OR ERROR FREE OR THAT THE BEACONS WILL MEET YOUR OR ANY THIRD PARTY’S EXPECTATIONS.
NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY OUR REPRESENTATIVES OR EMPLOYEES SHALL CREATE A WARRANTY OR IN ANY WAY INCREASE THE SCOPE OF OUR OBLIGATIONS.
